801 Visa Overview

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. It is usually only for people who currently hold a temporary Partner visa (subclass 820).

801 Visa Conditions

As the visa applicant, you must,

  • hold a temporary Partner visa (subclass 820)
  • in most cases, continue to be in a married or de facto relationship with your sponsor

Eligibility

  • You must hold a Partner visa (subclass 820) or a Dependent Child visa (subclass 445).
  • Usually, 2 years must have passed since you applied for the combined 820 and 801 visa for you to be assessed for the permanent visa.
  • You must continue to be the spouse or de facto partner of the same person who sponsored you for the temporary visa.
  • You must usually continue to be sponsored.
  • You must not have any debt to pay to the Australian government.
  • With under 18 applicants, it must be in the best interest of them.

801 Visa Processing Time

The 801 visa application can take at least seven (7) months up to twenty-three (23) months to be finalized.

The processing time begins two years after you have applied for the combined temporary and permanent partner visas.
